Warning: Possible Discrimination in Fresh Harvest Job Fair (San Quintin, Baja California)

Residents of San Quintin (Baja California) and the surrounding areas, you may have seen ads for the Fresh Harvest job fair, inviting men between the ages 18 and 39 to apply for jobs in agriculture. This may be discrimination!

Remember the following:

  • Selecting or recruiting candidates based on age and gender is illegal in the United States and in Mexico, and it could be illegal for a US company to hire you under these circumstances.

  • Employers cannot give preference to candidates because of their race; their country of origin; their religion; for being pregnant; or having certain disabilities.

  • It is illegal for recruiters or employers to charge a fee in exchange for work or the possibility of working in the United States with the H-2A visa.

 

In June 2016, Centro de los Derechos del Migrante filed a complaint for labor discrimination of migrant women against the governments of the US and Canada since it is illegal for anyone to be paid less or not be hired based on gender.
