Do you work or have you worked on an H-2B visa at fairs or amusement rides in the United States? We are looking for you! 

Each year, thousands of people travel to the United States to be employed with a temporary H-2B work visa.  

This category of visa is currently utilized by U.S. employers in fairs, amusement rides, or travelling carnivals, among other activities, to bring workers from other countries to engage in different tasks related to setting up and servicing the entertainment space, for example: selling entrance tickets to the events, selling, serving, or preparing food in mobile carts, operating the rides, assembling and disassembling the rides or installations, cleaning and organizing the space. This type of work involves long days before, during, and after each event, but migrant workers often receive minimum wage and live in very precarious conditions. However, the majority of these workers do not complain due to a lack of knowledge of their labor rights and fear of illegal retaliation, including fear that they will lose their position for the next season for having requested better labor conditions. 

In this post, we will share with you some of the rights and guarantees to which H-2B workers are presently entitled. 

A few rights of the most important rights and guarantees you could have are:

  • The right to receive a contract in your language before starting work, in which your guarantees, benefits, and labor conditions are detailed 

  • The right to receive your promised salary for each hour worked

  • The right to receive reimbursement for expenses incurred for your travel from your community to the workplace in the United States. 

  • The right to the ¾ guarantee, which protects migrant workers in case an employer does not offer the hours promised in the contract 

  • No discrimination: the right to not experience different treatment at work or in recruitment due to our sex, sexual orientation, gender, race, country of origin, or age above 40 years.
