US Ambassador to Mexico, Mexico Secretary of Labor and Social Welfare, and Wage and Hour Division Principal Deputy Administrator launch a pilot program aimed at returning wages owed to H-2A migrant workers 

On March 13, 2023, US Ambassador to the Mexico, Ken Salazar, Mexico Secretary of Labor and Social Welfare (STPS), Luisa María Alcalde and Principal Deputy Administrator for the Wage and Hour Division (WHD), Jessica Looman, attended a launch ceremony for the U.S.-Mexico Return of Migrant Wages Pilot Program. This pilot program is a clear example of how coordinated advocacy between Mexico and the United States to enforce U.S. labor laws, respect human and labor rights, and provide a pathway to access justice.

The program will allow Mexico and the U.S. Department of Labor (DOL) to coordinate efforts to return unpaid wages collected by the Wage and Hour Division to workers from Mexico with H-2A visas.

The Wage and Hour Division (WHD) identified approximately 13,000 H-2A workers from Mexico that are collectively a total of $6.5 million dollars, but WHD has not been able to locate the workers. Through this program, the WHD and STPS in Mexico will immediately begin to share information to help identify the workers that earned income in the United States but have returned to Mexico. Once workers have been identified, they will be directed to a public database of the WHD, Workers Owed Wages, where they will be able to see if they are owed wages. The database is available in Spanish and can be translated to other indigenous languages. 

The back wages will be withheld for three years while workers are located, after which time the money will be sent to the United States Department of the Treasury.

As part of the pilot program, DOL and STPS en Mexico will collaborate on outreach campaigns to raise awareness about the program and help workers navigate the database.
